View Full Version : Shrubbie Caught speeding in Iredell County, 125 mph in a 45 zone!

Ok, I heard this second hand from a friend of mine who has Sirius and the NASCAR channel welded to his ears. I havne't bothered to Google up a link...since some of you are down in the Carolinas. What I am asking is why no one has talked about this?

I find it galling and distressing this NASCAR board is so slim for readers no one is even talking about this....

It happened a few days ago (was posted on a couple of other boards). His wife was in the car with him. Might lose his driver's license, but very probably won't. Nascar (surprisingly) does not require a street license to race, so they don't care.

It was unfortunate that Ky B. decided to do something so dangerous, but then we were all young once. I can recall a couple of stupid things that I did in my youth that I thank the lord no one had to suffer because of those miguided actions. He got out of this without injuring himself or someone else who happened to have the misfortune to be in the wrong place at the wrong time. I hope he learned from this and matures by it.

But that was one honey of a car he was driving. At 128 it was only a little over half throttle.

He's 26 years old so he should be matured by now. Those who enable his bad behavior are slowing the maturation process he should've achieved by now. Thankfully nobody was injured or killed while he irresponsibly playing with this toy.

I heard he has just a Lexus sedan.

For those who think this is nothing, any time a race driver does something like this, it usually means the sponsors sit on him and slap him around a little, and you have to know Joe Gibbs has a migraine from it.

What is shows of course is Kyle Busch, for all his talent is still a bit of a dope. Getting married hasn't changed his idiot tendencies a bit.

NASCAR I don't think likes the negative publicity, but ya, they don't care if he loses his road license or not. That's true.....

I just found it rare that on this board, where most either love or hate Shrubbie, no one even commented on it....we need to recruit some fans to this board....

there are such things as private test tracks/road courses that Kyle could've easily gone to and had fun, these are public roads and and should know the responsibility in driving on the roads. his license should be suspended and prolly a fine, at least thats what normal people would receive. these "athletes and celebrities" need to get off cloud-9 and back to reality where they do something stupid, they SHOULD get punished for it just like everyone else. hell the NFL is starting to do a good job by holding guys accountable also and suspend them for off-the-field anticts.

And he got a ticket, will go to court, pay his fine, and move on just like anyone else of us who have been busted for haulin ass on the street...Move along, nothing to see here....

Actually, the officer kinda heeped it up on him a little bit....anything over 80 is already a misdemeanor in NC NC GS 20-141 covers the different levels of speeding, and 80mph (or any speed that is 15mph over 55-provided that that speed isnt legalised by a 70mph speed limit) is treated in pretty much the same manner as opposed to lesser numbers that would only be considered an infraction-not a criminal offense.

Since the 128 in a 45 is covered by the "over 80/15 over 55" subsection it is a misdemeanor, therefore a criminal offense, hence the "mandatory" court appearence.

The added charge of "careless and reckless" was not really neccesary and seems to be just piling on-unless there was some other deal going on, like weaving in and out of traffic, running people off the road, (etc).

What will probably end up happening is that shrub will prolly plead guilty to the speeding, the C and R will prolly be dropped, and he'll get a $250 fine and lose his licesence for a year-which is actually harder on him than it would be on the rest of us. Because he is famous, he probably wont have the oppoptunity to plea guilty to an equipment violation, thereby wiping out the speeding and keeping his licence-the press would have an absoloute field day with that "their being too lenient on him because he's famous (etc etc etc). But that's what most people in NC do when popped for going over 80.....

No, actually you are putting words in my mouth. What I am saying is is that the two charges, at least in NC are very similiar in their severity and proscribed penalty, to wit:


§ 20‑141. Speed restrictions.

(j1) A person who drives a vehicle on a highway at a speed that is either more than 15 miles per hour more than the speed limit established by law for the highway where the offense occurred or over 80 miles per hour is guilty of a Class 2 misdemeanor.


§ 20‑140. Reckless driving.
(b) Any person who drives any vehicle upon a highway or any public vehicular area without due caution and circumspection and at a speed or in a manner so as to endanger or be likely to endanger any person or property shall be guilty of reckless driving.
(d) Reckless driving as defined in subsections (a) and (b) is a Class 2 misdemeanor.


So as you can see both charges are very similar. The only minor difference is that the license points are 4 for the speeding charge and 5 for the c/r, but upon conviction of both only the higher point value is able to be assesed by law, so if convicted on both he would only have 5 points, not 9....

Both carry a mandatory suspension and the max fine is similiar as both are class 2 misdemeanors and in general the fine is for one or the other, not both.

Rarely, if ever, is jail time ever even considered for this, especially when no collision occured.

Personally for 128 in a 45, most of the deputies I work with would have hooked him up with the C&R (higher points) and called it good.

There is really no way to plead C&R down to a lesser included offense, whereas with the speeding charge he coiuld plead guilty to a slower speed (etc,etc etc).....

Look-one look at my signature will tell you that Im no shrubbie fan-personally hope Harvick plants him in the fence at the earliest opportunity after their probation is lifted-but at least I have been able to lay off the Hateraid. That's the problem out here in the world lately. Everybody is so fixated with their hatred for driver/athlete/team "X" so that no matter what they do, the rights are never right enough, and the wrongs are so wrong that body parts being shed by the offender would not be enough for some people.

Kyle is a racecar driver and while I can't condone what he did I think he just got carried away.

BTW didn't Juan Pablo go 100+ in Indy last year? No one said much about that...

I don't remember for sure, but I think you are right. I wanna say that was on the interstate though, and that maybe why no one is making a huge fuss-many people are in agreement that the speed limits on the interstates are a joke and really only there to produce revenue for states and counties that patrol them....

Shrub was on a twisty two lane road and that's why people are all up in arms-that and the fact it was shrub that is the offender.

Well considering the car, the driver and the mentality, it doesn't surprise me. He loses his license for a year, and has to be driven everywhere......good learning lesson for someone who has had a lot on his plate from a young age as far as attention and doesn't seem to handle it well.....
